An injured employee who has missed seven consecutive days of work due to an on-the-job accident or work-related injury is entitled to wage benefits under Georgia workers’ compensation laws. If an employee misses more than 21 consecutive days of work, the employee must be paid wage benefits for the first seven days off the job. The payment must be made within 21 days after the first day of work missed.
If you have been injured while on the job, contact the workers compensation lawyers at Burnside Wall. Under workers’ compensation laws, an injured worker is eligible for two thirds of the average weekly wages, based on the wages received for the 13 weeks prior to accident. The average weekly wage is calculated by adding the amount of wages or salary earned in the 13 weeks before accident and then dividing that number by 13. The result is then multiplied by two thirds (or .66). The injured employee can receive the weekly wages as long as the employee authorized doctor says that the employee is disabled for work-related injuries. There is a cap on these weekly wages that changes every year.
